History

Green Planning Studio Ltd began life as Green Planning Solutions LLP established by Matthew Green in 2005. It became a limited liability partnership in 2007 when Matthew was joined by Ruth Reed PPRIBA. The practice grew steadily as a planning-led consultancy specialising in gaining planning permission in areas of development constraint such as the countryside, Green Belt and Areas of Outstanding Natural Beauty supported by in-house expertise in planning, architecture, surveying, historic environment, flood risk assessment, contaminated land and landscape design.

Green Planning Studio Ltd was formed in 2013 with the arrival of the barrister, Michael Rudd who joined Ruth and Matthew as Directors as the portfolio expanded to include services for self-builders facing planning issues and specialist legal support for planning cases in the courts.

The National Planning Policy Framework (NPPF) provides opportunities for authorities, communities and developers alike. However, the NPPF’s light touch leaves interpretation open with little case law upon which to predict outcomes. Legal Support

The law associated with planning is highly specialised and Green Planning Studio has the knowledge and experience to support you at all levels of the court system. We can help you by:

  • Drafting Section 106 agreements – A council can enter into a Section 106 agreement, otherwise known as a ‘planning obligation’, with a developer where it is necessary to provide contributions to offset negative impacts caused by construction and development.
  • Acting as intermediaries if you engage a barrister through a direct access agreement in:
    • Statutory reviews against appeal decisions under Section 288 and Section 289 of the Town and Country Planning Act 1990
    • Criminal prosecutions relating to non-compliance with enforcement notices or breach of conditions notice
    • Injunction and committal proceedings under Section 187 of the Town and Country Planning Act 1990
    • Judicial review of a decision in the planning process, for example where a local authority has declined to determine an application under Section 70 of the Town and Country Planning Act 1990
