Caravan Site in Cornwall
A caravan site and a camping site confirmed without restrictions
A Section 191 application for a Certificate of Lawfulness for Existing Use or Development, a CLEUD was approved by the Council based on evidence that included sworn affidavits and date-marked aerial photography.
The site had an existing permission as a touring site, but more land outside the permission area had been used for many years. It was submitted that this had created a new planning unit and was a material change of use of the site. Cornwall Council agreed with the evidence and the submissions, and issued a certificate. The permission applying to part of the site is therefore superseded and an unconstrained mixed use across all of the site is deemed lawful. Provided some land within the site is kept available for tents, the remainder of the site can now be occupied by residential mobile homes.
